Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Budgefy, an AI‑powered financial assistant service operated by Financial Literacy Group LLC ("Company," "we," "us"). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Service Description

Budgefy provides budgeting tools, analytics, and AI‑generated insights based on financial data you connect (e.g., via Plaid) or enter manually. Budgefy is not a bank, broker, investment adviser, tax adviser, legal adviser, or fiduciary.

Third‑Party Services (including Plaid & AI)

We use third parties, such as Plaid, to connect financial accounts. By using these features, you authorize us and our providers to access and transmit your financial data as necessary to provide the Service. We do not store raw banking credentials; we use tokens. We may use third‑party AI infrastructure to deliver features; such providers are contractually restricted to using your information only to provide services to us, not to train unrelated models, unless you expressly consent.

AI Features; No Professional Advice; Your Responsibility

• AI outputs are informational and educational only.
• Budgefy does not provide individualized investment, legal, tax, or accounting advice; no fiduciary relationship is created.
• You are solely responsible for evaluating and acting on any recommendations or insights.
• Consult qualified professionals before making financial decisions.

Eligibility & Accounts

• You must be at least 18 and capable of forming a binding contract.
• You are responsible for safeguarding your credentials and all activity under your account.
• You must provide accurate information and update it as needed.

User Responsibilities (Acceptable Use)

• Use the Service lawfully and in accordance with these Terms.
• Do not reverse engineer, scrape, or attempt to extract source code, models, or datasets.
• Do not use the Service to build or train competing models or products.
• Do not upload unlawful, harmful, or infringing content or attempt unauthorized access.
• You represent you have the lawful right to provide any data you submit.

Financial Offers, Affiliates, and Advertising

We may present targeted offers, referrals, or affiliate links to third‑party products/services based on your usage or de‑identified/aggregated insights. We do not disclose your identifiable financial data to such third parties for their independent use without your consent. You may opt out of “sharing” for cross‑context behavioral advertising in settings or by contacting support@budgefy.io.

Subscriptions, Fees & Trials

• We may offer free, trial, or paid plans with disclosed pricing, features, and billing cycles.
• Plans may auto‑renew until canceled; cancel any time in settings to stop the next charge.
• Taxes may apply. Except where required by law, fees are non‑refundable.
• We may change prices and features prospectively with notice where required.

Intellectual Property & License

We and our licensors own the Service and related intellectual property. Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for your personal, lawful purposes. You retain ownership of your content and data; you grant us a license to use it solely to provide, secure, maintain, and improve the Service, to comply with law, and as described in the Privacy Policy.

Data Use for Improvement; De‑Identification

We may use de‑identified and/or aggregated information derived from your data and use of the Service for analytics, quality, security, research, and product improvement. We do not use your identifiable financial data to train publicly available models.

Disclaimers

THE SERVICE, INCLUDING ANY AI‑GENERATED OUTPUTS, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant accuracy, completeness, reliability, or availability, and outcomes may vary based on your circumstances.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Indemnification

You will indemnify and hold harmless the Company and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or third‑party rights.

E‑SIGN Consent

By creating an account or clicking “Accept,” you consent to receive communications and disclosures electronically and agree that your electronic signature is binding. You may withdraw consent by contacting support@budgefy.io; withdrawal may affect your ability to use the Service.

Dispute Resolution; Arbitration; Class Waiver

• Governing law: California (conflicts principles excluded). Venue: Los Angeles County courts, subject to arbitration.
• Binding arbitration under the AAA Consumer Arbitration Rules, in Los Angeles County, CA, or via video/teleconference at the arbitrator’s discretion. You and we waive any right to a jury trial and to participate in class or representative actions; the arbitrator may award individualized relief only.
• 30‑day opt‑out: email support@budgefy.io within 30 days of first accepting these Terms with your name, account email, and a clear request to opt out of arbitration.
• Small‑claims court carve‑out: Either party may bring an individual action in small‑claims court.

Export & Sanctions Compliance

You may not use the Service if you are subject to U.S. sanctions or restrictions. You must comply with applicable export control and sanctions laws.

Changes to Service and Terms; Termination

We may modify or discontinue all or part of the Service at any time. We may update these Terms; material changes will be posted and, where required, we will notify you or seek consent. Your continued use after changes become effective constitutes acceptance. We may suspend or terminate access for any lawful reason. Upon termination, your right to use the Service ceases; provisions that should survive will survive.
